Hybrid offence with a 10-year maximum. Constitutes serious criminality under IRPA s.36(1). Knowing unauthorized possession of a firearm carries more severe immigration consequences than simple unauthorized possession.

Every person commits an offence who possesses a prohibited firearm, a restricted firearm or a non-restricted firearm knowing that the person is not the holder of a licence under which the person may possess it and knowing that the person is not the holder of a registration certificate for the firearm.
