You are in this class if an officer outside Canada decides you are a Convention refugee. Notice who decides: a visa officer abroad, not the Refugee Board and not the UN refugee agency, although a referral from that agency is usually how you get in front of the officer in the first place.

Legal Text: IRPR Regulation 145
145 A foreign national is a Convention refugee abroad and a member of the Convention refugees abroad class if the foreign national has been determined, outside Canada, by an officer to be a Convention refugee.
