Receiving a material benefit from trafficking is a hybrid offence with a 10-year maximum for adult-victim trafficking and a straight indictable offence with a 14-year maximum where the victim is under 18. Under IRPA s.36(3)(a) it is deemed indictable; the under-18 form is serious criminality under s.36(1)(a) and may also engage organized criminality under s.37.

(1) Every person who receives a financial or other material benefit, knowing that it is obtained by or derived directly or indirectly from the commission of an offence under subsection 279.01(1), is guilty of (a) an indictable offence and liable to imprisonment for a term of not more than 10 years; or (b) an offence punishable on summary conviction. (2) Material benefit, trafficking of person under 18 years: Everyone who receives a financial or other material benefit, knowing that it is obtained by or derived directly or indirectly from the commission of an offence under subsection 279.011(1), is guilty of an indictable offence and liable to imprisonment for a term of not more than 14 years and to a minimum punishment of imprisonment for a term of two years.
