Inadmissibility
🍁 In Simple Terms

A person is inadmissible for failing to comply with the Act. For a foreign national, this covers any act or omission that contravenes the Act (for example, overstaying or working without authorization). For a permanent resident, it means failing to comply with the residency obligation in s.28 or the conditions referred to in s.27(2).

Legal Text: IRPA Section 41

41 A person is inadmissible for failing to comply with this Act (a)in the case of a foreign national, through an act or omission which contravenes, directly or indirectly, a provision of this Act; and (b)in the case of a permanent resident, through failing to comply with subsection 27(2) or section 28.
