If the Minister asks for an inquiry, Cabinet can appoint a superior court judge to run it, on the Justice Minister's recommendation. An outside judge, not the Board itself, looks into the member's conduct.

178 On receipt of a request referred to in paragraph 177(c), the Governor in Council may, on the recommendation of the Minister of Justice, appoint a judge of a superior court to conduct an inquiry.
