IRPRPART 5 Permanent ResidentsDIVISION 2 Residency Obligation
r.62

Calculation — residency obligation

Permanent Residents
🍁 In Simple Terms

Days you spend outside Canada while on assignment for a Canadian business count toward your residency obligation, but only up to the point that a removal report is filed against you for non-compliance, or until a decision outside Canada is made that you've failed to comply. If you're later found compliant, the count can resume.

Affects: Foreign nationals and permanent residents in Canada
Legal Text: IRPR Regulation 62

(1)Subject to subsection (2), the calculation of days under paragraph 28(2)(a) of the Act in respect of a permanent resident does not include any day after (a)a report is prepared under subsection 44(1) of the Act on the ground that the permanent resident has failed to comply with the residency obligation; or (b)a decision is made outside of Canada that the permanent resident has failed to comply with the residency obligation.
