Reopening appeal

🍁 In Simple Terms

The IAD can reopen an appeal in limited circumstances — for example, if the person failed to appear and had a valid reason, or if a serious breach of procedural fairness occurred. Reopening is discretionary and not a routine remedy.

71 The Immigration Appeal Division, on application by a foreign national who has not left Canada under a removal order, may reopen an appeal if it is satisfied that it failed to observe a principle of natural justice.
