§156

Immunity and no summons

🍁 In Simple Terms

Board members cannot be sued or prosecuted for anything they did in good faith in the job, and they cannot be called as witnesses in civil proceedings about their work. The point is to keep decision-makers independent.

156 The following rules apply to the Chairperson and the members in respect of the exercise or purported exercise of their functions under this Act: (a)no criminal or civil proceedings lie against them for anything done or omitted to be done in good faith; and (b)they are not competent or compellable to appear as a witness in any civil proceedings.
