§106

Credibility

Credibility

Refugee Protection
🍁 In Simple Terms

When deciding whether to believe your refugee story, the board will look at whether you have valid identity documents. If you don't have them, you need to explain why or show you tried to get them — otherwise your credibility may be seriously questioned.

Affects: Refugee claimants and protected persons
Legal Text — IRPA Section 106

106 The Refugee Protection Division must take into account, with respect to the credibility of a claimant, whether the claimant possesses acceptable documentation establishing identity, and if not, whether they have provided a reasonable explanation for the lack of documentation or have taken reasonable steps to obtain the documentation.
