Frequently Asked Questions

What does "inadmissible to Canada" mean?+

Under the Immigration and Refugee Protection Act (IRPA), a person is inadmissible if they have a criminal record, health condition, security concern, financial issue, or misrepresentation that bars them from entering Canada. Sections 34–42 of IRPA outline the specific grounds.

Can I enter Canada with a DUI or DWI conviction?+

A DUI is treated as a serious offence in Canada (equivalent to a hybrid/indictable offence after the December 2018 Criminal Code changes). You may be inadmissible unless you qualify for deemed rehabilitation (10+ years since sentence completion), criminal rehabilitation, or a Temporary Resident Permit (TRP).

What is criminal rehabilitation and how do I apply?+

Criminal rehabilitation is a permanent solution under IRPA s.36(3)(c). You can apply if at least 5 years have passed since you completed your entire sentence (including fines, probation, and driving prohibitions). The application is made to IRCC and, if approved, permanently removes the inadmissibility.
